In the early morning hours of November 30, a passenger was ejected from her Uber when another vehicle smashed into the side of the rideshare car in the Clinton Hill section of Brooklyn.
Around 12:30 a.m., the driver of a Dodge Charger sped through a red light at Bedford Avenue and Dekalb Avenue. As a result of running the red light, the Charger struck a rideshare vehicle, injuring those inside. Surveillance video showed the force of the crash, which sent the rideshare car, a Honda Accord, onto the sidewalk, coming to rest in front of a deli.
The passenger, a 32-year-old female, was ejected from the vehicle and rushed to Bellevue Hospital. According to ABC7, she is in critical condition with unknown injuries.
Both the Uber driver and driver of the Dodge Charger were taken to the hospital. The Uber driver was taken to Bellevue and has been deemed stable. The other driver, 22-year-old Ryan Ortiz of Middletown, NY, was taken to Kings County Hospital and is also considered to be in stable condition.
While there is an ongoing investigation, Ortiz appears to have traveled through the red light at a high rate of speed. There are charges against him, pending the outcome of the investigation.
When an accident like this occurs, the victims are often left to wonder where they will obtain compensation for their losses. When an Uber driver is involved, it’s possible the company’s insurance policy could come into play.
Who is awarded compensation is dependent on who is determined to be at fault for the crash. Suppose, in the situation above, the Dodge Charger driver is found to be at fault. In that case, it’s likely his insurance policy will need to be used to cover the damages and losses incurred by the Uber driver and passenger.
