Uber Sued After Fatal University of Florida Accident

The families of two University of Florida students are taking legal action against Uber and other parties after an accident resulted in both injuries and a fatality.

The parents of Sophia Lambert, 18, are seeking unspecified damages for the death of their daughter. The South Florida law firm Grossman Roth Yaffa Cohen is representing the family. On January 16, 2021, Lambert was killed after a crash on West University Avenue and 17th Street. The family of Michelle Berglass, who was injured in the same crash, has filed a separate lawsuit, also seeking unspecified damages.

Benjamin A. Piper was driving a Honda Civic east when he collided with Boris V. Stoyanov, who was turning left at 17th Street. Piper skidded sideways, hit a pole, and struck Lambert, as well as four others. When Lambert was struck, she was thrown thirty feet through the air into a brick bench.

The family is looking to hold Piper, Stoyanov, Uber, and Portier LLC, a subsidiary that operates Uber Eats, accountable for Lambert’s death. The lawsuit claims that Uber and Portier failed to train, observe, and supervise Piper as a driver. In addition to that, the case is alleging that Uber encourages distracted and unsafe driving. In regard to Stoyanov, the suit alleges he drove negligently in failing to yield the right of way to Piper.

According to the Berglass suit, “Uber developed the app, which distracts drivers sharing the roads with other drivers and pedestrians and requires and encourages unsafe driving. Additionally, the Uber defendants incentivize speed through the APP and their compensation policies.”

As a result of the accident, police have increased enforcement of traffic violations on West University Avenue and other streets near the campus. The Florida Department of Transportation has also added signs and signals in the area. According to state transportation officials, Gainesville City commissioners can take on responsibility for that section of University Avenue so it can be redesigned.
